Retention time

Personal Data shall be processed and stored for as long as required by the purpose they have been collected for.

Therefore:

  • Personal Data collected for purposes related to the performance of a contract between the Owner and the User shall be retained until such contract has been fully performed.
  • Personal Data collected for the purposes of the Owner’s legitimate interests shall be retained as long as needed to fulfill such purposes. The Owner may be allowed to retain Personal Data for a longer period whenever the User has given consent to such processing, as long as such consent is not withdrawn. Google Analytics is a web analysis service provided by Google Ireland Limited (“Google”). Google utilises the Data collected to track and examine the use of this Application, to prepare reports on its activities and share them with other Google services.
Google may use the Data collected to contextualise and personalise the ads of its own advertising network.

Google Ads conversion tracking is an analytics service provided by Google LLC or by Google Ireland Limited, depending on how the Owner manages the Data processing, that connects data from the Google Ads advertising network with actions performed on this Application.

By filling in the contact form with their Data, the User authorises this Application to use these details to reply to requests for information, quotes or any other kind of request as indicated by the form’s header.

Facebook Custom Audience is a remarketing and behavioral targeting service provided by Meta Platforms, Inc. or by Meta Platforms Ireland Limited, depending on how the Owner manages the Data processing, that connects the activity of this Application with the Facebook advertising network.

Users can opt out of Facebook’s use of Trackers for ads personalization by visiting this opt-out page.

This type of service allows you to view content hosted on external platforms directly from the pages of this Application and interact with them.
This type of service might still collect web traffic data for the pages where the service is installed, even when Users do not use it.

This type of service allows the Owner to build user profiles by starting from an email address, a personal name, or other information that the User provides to this Application, as well as to track User activities through analytics features. This Personal Data may also be matched with publicly available information about the User (such as social networks’ profiles) and used to build private profiles that the Owner can display and use for improving this Application.
Some of these services may also enable the sending of timed messages to the User, such as emails based on specific actions performed on this Application.

Appendix 1 to the General Conditions “Personal Data”

As part of its activities, Peak Advertising Limited collects personal data relating to managing its clientele, i.e. all personal data required to set up, manage, and monitor the files of lessors and lessees (hereinafter referred to as the “Lessors”, “Lessees” or “Guests”).

    2.1. Data collected from our Guests
    As part of its contractual relationship, Peak Advertising Limited may collect and process information from:
    • Lessees, including: first and last names, dates of birth, copies of ID cards, telephone numbers, postal addresses, email addresses, copies of passports, marital status, information on family members, bank details, history of the contractual relationship, behavioral and web browsing data, food allergies, disability status
    • Lessors, including: first and last names, dates of birth, copies of ID cards, telephone numbers, postal addresses, email addresses, contractual relationship history, behavioral and web browsing data.

    2.2. Purposes for collecting personal data
    The data collected during the contractual relationship are subject to automated processing for the purpose of:
    • performing the contractual commitments;
    • contacting the Guests;
    • avoiding any illicit or illegal activity;
    • enforcing the general conditions;
    • filing legal proceedings;
    • vetting the Guests ID.

    2.3. Legal basis for processing
    The legal basis for the data collected is a contractual relationship.

    2.4. Data recipients
    The data collected may only be consulted by Peak Advertising Limited within the limits strictly necessary for performing its contractual obligations.
    This data, whether in individual or aggregated form, is never made freely accessible to a third party.

    2.5. Personal data retention period
    The personal data collected is kept for the duration of the contractual relationship and for the time during which Peak Advertising Limited may be liable.
    Once the retention period has expired, Peak Advertising Limited agrees to permanently delete the data subject’s data without keeping a copy.

    2.6. Personal data security and confidentiality
    Personal data is stored in secure conditions, according to current technical means and in compliance with the provisions of the General Data Protection Regulation and the current national laws.

    2.7. Data minimization
    Peak Advertising Limited may also collect and process any data voluntarily submitted by its Guests.
    Peak Advertising Limited advises its Guests to provide personal data that is strictly necessary for managing its customer base.
    Peak Advertising Limited agrees to only store and process data that is strictly necessary for managing its customer base and will delete any data received that is not useful for its activities as soon as possible.

    2.8. Respecting rights
    Guests have the following rights concerning their personal data, which they can exercise by writing to the following address: privacy@kukoto.com.
    2.8.1. Right to information, access and communication of data
    Peak Advertising Limited’s Guests have the right to access their personal data.
    Due to Peak Advertising Limited’s obligation of security and confidentiality when processing personal data, requests will only be processed if Guests provide proof of their identity, in particular by submitting a scan of their valid ID (in the case of a request submitted via the dedicated electronic form) or a signed photocopy of their valid ID (in the case of a written request), both of which must be accompanied by the words “I hereby certify on my honor that the copy of this ID is a certified true copy of the original. Drawn up in … on … ”, followed by their signature.
    2.8.2. Right to rectify and delete data and right to be forgotten
    Peak Advertising Limited’s Guests have the right to request the rectification, updating, blocking, or erasure of their personal data that may be inaccurate, erroneous, incomplete, or obsolete.
    Guests of Peak Advertising Limited may also specify general and specific instructions regarding the fate of their personal data after their death. Where applicable, the heirs of a deceased person may request that the death of their loved one be taken into consideration and/or that the necessary updates be made.
    2.8.3. Response Times
    Peak Advertising Limited agrees to respond to every request to access, rectify, oppose, or any other additional request for further information within a reasonable time period which may not exceed 1 month from receipt of the request.

    2.9. Data transfer
    2.9.1. Transfer to partners
    Peak Advertising Limited uses authorized service providers to assist in the processing of data for its services. These service providers may be located outside the European Union.
    Peak Advertising Limited has previously ensured that its service providers have implemented adequate guarantees and comply with strict rules regarding confidentiality, use, and data protection.
    2.9.2. Transfer upon request or a court order
    The Guest also agrees that Peak Advertising Limited may disclose the data collected to any person upon request by a governmental authority or a court order.
    2.9.3. Transfer in connection with a merger or acquisition
    If Peak Advertising Limited is involved in a merger, sale of assets, financing transaction, liquidation or bankruptcy or in an acquisition of all or part of its business by another company, the Guest consents to the data collected being transferred by Peak Advertising Limited to that company and to that company processing personal data as described herein.

The rights of Users

Users may exercise certain rights regarding their Data processed by the Owner.

In particular, Users have the right to do the following:

  • Withdraw their consent at any time. Users have the right to withdraw consent where they have previously given their consent to the processing of their Personal Data.

What are the purposes for which we use your personal information?

The right to know and to portability

You have the right to request that we disclose to you:

How to exercise your rights

To exercise the rights described above, you need to submit your verifiable request to us by contacting us via the details provided in this document.

For us to respond to your request, it’s necessary that we know who you are. Therefore, you can only exercise the above rights by making a verifiable request which must:

  • provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorised representative;
  • describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We will not respond to any request if we are unable to verify your identity and therefore confirm the personal information in our possession actually relates to you.

If you cannot personally submit a verifiable request, you can authorise a person registered with the California Secretary of State to act on your behalf.

If you are an adult, you can make a verifiable request on behalf of a minor under your parental authority.

You can submit a maximum number of 2 requests over a period of 12 months.

How and when we are expected to handle your request

We will confirm receipt of your verifiable request within 10 days and provide information about how we will process your request.

We will respond to your request within 45 days of its receipt. Should we need more time, we will explain to you the reasons why, and how much more time we need. In this regard, please note that we may take up to 90 days to fulfill your request.

Our disclosure(s) will cover the preceding 12 month period.

Should we deny your request, we will explain you the reasons behind our denial.

We do not charge a fee to process or respond to your verifiable request unless such request is manifestly unfounded or excessive. In such cases, we may charge a reasonable fee, or refuse to act on the request. In either case, we will communicate our choices and explain the reasons behind it.

Personal Data (or Data)

Any information that directly, indirectly, or in connection with other information — including a personal identification number — allows for the identification or identifiability of a natural person.

 

Usage Data

Information collected automatically through this Application (or third-party services employed in this Application), which can include: the IP addresses or domain names of the computers utilised by the Users who use this Application, the URI addresses (Uniform Resource Identifier), the time of the request, the method utilised to submit the request to the server, the size of the file received in response, the numerical code indicating the status of the server’s answer (successful outcome, error, etc.), the country of origin, the features of the browser and the operating system utilised by the User, the various time details per visit (e.g., the time spent on each page within the Application) and the details about the path followed within the Application with special reference to the sequence of pages visited, and other parameters about the device operating system and/or the User’s IT environment.
